Questions Consumers Should Ask & The Answers

  1. How can I make financial and medical decisions for my child after he turns 18 if he is incapacitated? Your young adult needs a Durable Power of Attorney and Designation of Healthcare Surrogate so that you can make decisions in case he is in an accident or ill.
  2. Is it a good idea to transfer my home to my child in case I need Medicaid assistance? Not necessary. Transferring your home will cause you to lose your homestead exemption and cause delay in qualifying for Medicaid. Your situation should be evaluated.
  3. Why shouldn’t I name my children as Personal Representative of my Last Will & Testament or, as Successor Trustee of my Revocable Trust? Naming an impartial fiduciary will contribute to maintaining peace and harmony in the family.
  4. I am gay and considering marrying my partner. What should I think about? Explore the pros and cons of your rights and responsibilities under federal laws such as Social Security benefits, the tax code, veteran benefits as well as state benefits such as homestead tax exemption, and inheritance rights.
  5. I am getting divorced and my spouse will pay child support for our adult disabled child. Can my child qualify for government benefits? Child support counts as income unless you hire an elder law attorney to create a special needs trust and obtain a court order directing the child support payments into the trust.
  6. Should I sign the admission agreement for the nursing home/assisted living facility on behalf of my parent/spouse? If your parent is competent have him sign the agreement. Otherwise if you are the power of attorney or healthcare surrogate indicate that when you sign it to avoid being a guarantor of payment.
